The agreement.
These Terms are a binding agreement between you and Thrive at Work s.r.o., a company registered in Prague, Czech Republic. By accessing the website at thriveatwork.ai or using the Thrive Index platform, you agree to these Terms.
If you are agreeing to these Terms on behalf of an organisation, you confirm that you have authority to bind that organisation, and "you" in these Terms refers to that organisation.
What the service is.
Thrive at Work provides:
- The Thrive Index — a validated instrument that measures capacity and engagement across eight domains
- Dashboards and reports for executives, CHROs, managers and employees
- Thrive Academy — micro-courses delivered to each employee based on their results
- Research, benchmarks and publications derived from anonymised data
We continuously improve the service and may add, modify or deprecate features. We will give reasonable notice before removing material functionality from a paying customer's deployment.
Accounts and access.
The platform is provided to organisations that sign a separate commercial agreement (the Order Form). Employees of those organisations access the platform under their employer's deployment. Individual consumer accounts are not available.
You are responsible for:
- Maintaining the confidentiality of access credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised access
Acceptable use.
You may not:
- Use the service to harass, surveil or harm any individual
- Attempt to re-identify employees from aggregated data
- Use survey data as the sole basis for disciplinary or employment decisions
- Reverse-engineer, decompile or scrape the service or its content
- Resell, sublicence or white-label the service without written permission
- Use the service in violation of any applicable law
We reserve the right to suspend access where use violates these terms or applicable law.
Intellectual property.
The Thrive Index methodology, the 55 statements, the eight-domain framework, the scoring model, and all associated software, visual design and content are the property of Thrive at Work and are protected by copyright, trade mark and trade secret law.
You retain ownership of any data your organisation provides. You grant us a limited licence to use that data to operate the service, compute your results, and — in anonymised, aggregated form — contribute to our benchmarks.
Data protection.
Our processing of personal data is governed by the separate Privacy policy and, where applicable, by the Data Processing Addendum attached to your Order Form. Nothing in these Terms overrides those documents.
Warranties and disclaimers.
We warrant that we will provide the service with reasonable skill and care, in accordance with published availability targets and these Terms. The Thrive Index is a measurement instrument — its outputs inform management decisions but do not replace them. The service is provided on an "as is" basis beyond the express warranties given here.
To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Limits of liability.
Neither party's liability to the other for indirect, incidental, special or consequential damages is accepted. Our aggregate liability for any claim arising from these Terms is limited to the fees paid by you in the twelve months preceding the claim. Nothing limits liability for fraud, wilful misconduct, or liability which cannot be limited by law.
Term and termination.
These Terms apply for as long as you use the service. You or we may terminate with 30 days' written notice. We may suspend or terminate immediately for material breach that is not cured within 14 days of notice.
On termination, we will export your organisation's data in a standard format and, unless legally required to retain it, delete it within 90 days.
Governing law.
These Terms are governed by the laws of the Czech Republic. Any dispute will be subject to the exclusive jurisdiction of the courts of Prague, without prejudice to mandatory consumer protections available to users located elsewhere in the EU.
